Terms of Service

These terms apply to services provided by Elvinsoft Technologies Limited (“Elvinsoft”, “we”) to you (“the client”). A written quote or proposal for your project forms part of these terms. If the quote and these terms differ, the quote applies.

1. Quotes and scope

• Every project starts with a written quote that lists what is included, the price in Kenya shillings (KES) and the expected timeline.
• Quotes are valid for 30 days unless stated otherwise.
• Work not listed in the quote (for example extra pages or features) is quoted separately before we do it.

2. Payments

• Website projects start after a deposit of 50% of the quoted price. The balance is due before the website is published on your domain, unless the quote says otherwise.
• Payments can be made by M-Pesa or other methods stated on your invoice.
• Bulk SMS credits are paid in full in advance. Hosting, domains and maintenance plans are paid in advance for the period chosen.
• Third-party costs such as domain registration, hosting, SMS credits, sender ID or short code fees and payment gateway charges are billed as stated in the quote.

3. Your part

• You provide text, photos, logos and other content on time, and confirm you have the right to use them.
• Delays in providing content or feedback may move the agreed timeline.
• You review the work when we share it and tell us about changes within the review period in your quote.

4. Revisions

Each quote includes a set number of revision rounds. Further changes after approval are charged at the rates in your quote.

5. Ownership

Once the project is paid in full, you own the website content and design created specifically for you. Third-party software, themes, plugins and libraries remain under their own licences. We may show the finished work in our portfolio unless you ask us not to.

6. Cancellation and refunds

You may cancel a project in writing at any time. We will refund any part of the deposit not yet covered by work completed up to the cancellation date. Completed work, used SMS credits, registered domains and third-party fees are not refundable.

7. Hosting, domains and email

• Domains are registered in your name or your organisation’s name.
• Renewals must be paid before the expiry date. We send reminders, but services may stop if renewals are not paid.
• You are responsible for content on your website and in your emails.

8. Bulk SMS and USSD

• SMS and USSD services are delivered through licensed network partners and are subject to their rules and approvals.
• You may only send promotional messages to people who agreed to receive them, and each message must allow recipients to opt out.
• You must not send spam, fraudulent, offensive or illegal content. We may suspend the service if these rules are broken.
• Delivery depends on the mobile networks; we are not responsible for delays or failures on their side.

9. Maintenance and support

Support after launch is covered only where it is included in your quote or a maintenance plan. Other support is charged at the rates we agree with you.

10. Liability

We take care to deliver reliable work, but we cannot guarantee that a website or system will be free of errors or always available. Our total liability for any claim is limited to the amount you paid us for the service concerned. We are not liable for indirect losses such as lost profits.

11. Privacy

We handle personal data as described in our Privacy Policy.

12. Law

These terms are governed by the laws of Kenya. We will try to resolve any dispute through discussion first.
